Centre for Mediation and Conciliation (Bombay Chamber of Commerce and Industry) is conducting an Awareness Seminar on Mediation: A Cost-Effective Tool for Resolution of Disputes for SMEs on June 14 at Mumbai.
About Centre for Mediation and Conciliation
Based on a survey of corporates operating in India, the Chamber has received feedback that there is growing dissatisfaction among the business houses of India about the time and cost required in the resolution of commercial disputes and enforcement of final outcome.
Mediation – A Cost-Effective Tool for Resolution of Disputes for SMEs
SMEs in India are vulnerable in pursuing litigation arising out of commercial disputes, because of their limited financial strength. Mediation offers them a level playing field. Some of the recent developments and provisions aim at quicker dispute resolution for SMEs.
Section 12 A of The Commercial Courts (Pre Institution Mediation and Settlement) Ordinance 2018, prescribes mandatory Mediation before a party can approach a commercial court with a Suit.
Section 18 of the MSME Act of 2006 prescribes that any party to a dispute should make a reference to the Micro and Small Enterprises Facilitation Council which shall either itself conduct conciliation in the matter or seek the assistance of any institution or centre providing alternate dispute resolution services by referring the dispute to such an institution or centre, for conducting conciliation.
In this context, Centre for Mediation and Conciliation (CMC), established by Bombay Chamber and recognised by Hon’ble Bombay High Court as a `Mediation Institution’ as per Commercial Courts Act 2015; jointly with Ministry of MSME, Government of India is organising an awareness seminar.
Objectives of the seminar
- To create awareness about Mediation in the context of Commercial Disputes
- To familiarise the SMEs and other stakeholders with recent amendments and procedures
- To address concerns and issues of SMEs in initiating Mediation/Conciliation process
- To share success stories and lessons from failures in Alternate Dispute Resolution
Owners and Entrepreneurs of SMEs/Startups/Partnership Firms; preferably Proprietors, Legal Heads, Compliance Officers, Sales Heads AND also Representatives of Large Corporates who deal with SME channels
